Kik files their statement of defence and counterclaim against Research In Motion

 

Just in case you’ve been wondering what has been happening in the Research In Motion vs. Kik Interactive legal proceedings we’ve got some new to share with you all. We’ve learned from David Lam that Kik Interactive has now filed their Statement of Defence and Counterclaim yesterday at some point. As you may remember, the filed documentation from Research In Motion (PDF) alleged that Kik Interactive CEO, Ted Livingstone while working at Research In Motion had access to sensitive Blackberry Messenger information. As such, the documentation goes on to allege that Ted used his position at Research In Motion to learn things about BlackBerry Messenger, which would later be used within the inner workings of Kik.

In their Statement of Defence and Counterclaim (PDF) Kik goes on to deny these allegations by stating in fact they were not developing Kik at the time of Livingstone’s employment at Research In Motion nor did they infringe upon any of Research In Motions trademarks or patents. They also make sure to point out that at the time, Livingstone had no access to the BlackBerry Messenger source code not any of Research In Motions development plans, market research, and other internal reports related to BlackBerry Messenger.

In the end, Kik Interactive claims the “overnight success of Kik Messenger” put Research In Motion execs on a mission to destroy or seriously harm Kiks reputation by abandoning previously set agreements such as those outlined in the BlackBerry App Word vendor portal and various other arrangements involving developer relations with Research In Motion. Kik claims the suspension and eventual removal of Kik from BlackBerry App World was nothing more just then beginning of a lawsuit, which Research In Motion knows, is meritless and has no real chance of success.

As with most legal cases, we’ll not likely find out anything else until after the dust settles but again, like most legal cases that’s where all the truth tends to come out from both parties and then we get the real story behind all the legal covering and paperwork. Either way, looking back at the situation we understand both parties’ situations. But surely somewhere along that line there has to be a happy medium between the two. Kik is doing well on other platforms and not having it available on the platform it initially launched with just seems wrong. Who knows? Maybe Kik working with Research In Motion on certain elements would be a good thing all around for both parties.

As expected, Verizon has now posted up the Desktop Manager install files for those of you with either a BlackBerry Bold 9650 or a BlackBerry Curve 3G 9330. You can head on over to to the Verizon Wireless website and grab the downloads if you never got the OTA install. Of course, if you’re running a previously leaked version then you can simply pass this one over.

XDA Member Files Class Action Lawsuit against T-Mobile and Samsung


MicBeast over at XDA has filed a class action lawsuit again T-Mobile and Samsung regarding the current rumors of Samsung withholding the Android 2.2 (Froyo) update for the Galaxy S line of devices. MicBeast has currently hired Edelson McGuire to represent the case. We here at AndroidSPIN are still flabbergasted at the tip we had received from an anonymous source claiming to work internally at T-Mobile. As we stated in our previous post although we cannot validate nor deny the alleged rumor, we felt it was necessary to bring it to the fore front. Check out the excerpt from MicBeast below.

they have continuously lied to us about the hardware,
and software reliability of this phone,
they promised us updates (to 2.2! Not the functionally dead JI6 2.1!)
over and over,
NOW they plan to release NEW galaxies
without updating the old ones they currently have
The GPS is clearly a hardware defect.
There are just too many issues with this phone
and the Customer service reps have been combative
even bullying and threatening customers!

We can only hope that this alleged rumor will help fix some of the corruption of whom ever holds these updates hostage, and gives the updates in which the consumers deserve.

Paul Allen Files Amended Patent Suit Against Apple, Google, and Others


Paul Allen, the co-founder of Microsoft, has filed a suit this week against Apple, Google, Facebook, AOL, Netflix, Yahoo, and several others claiming patent infringement.  Allen filed this suit on behalf of his old company Interval Licensing LLC, which is no longer in business.  He claims, however, that they hold various patents that are “fundamental to the ways that leading e-commerce and search companies operate today.”

What does that mean, exactly?  Allen’s claim is that Interval patented “technologies that display related content, provide unobtrusive on-screen alerts, and recommendations based on preference or online activity.”  His stance is that AOL’s ‘related links’ falls into this category, as does Facebook informing you via news feed what your friends are watching and playing, and Netflix’s recommendations based on your ratings of movies you’ve watched.  Also, the alert systems used by AOL, Yahoo IM, Apple, and the Android mobile OS are being targeted as infringing.

This suit was originally filed back in August, but the judge threw it out the first time, needed more specifics.  Well Allen has now re-filed, and we’ll have to wait and see how the courts view the case this time around.

Droid 2 SBF files released for rooted users who recently updated


Earlier this week, we posted an article letting everyone know that a Motorola Droid 2 update was released by Verizon Wireless. However, D2 users who have rooted their phones SHOULD NOT update their devices, as this could break your root and maybe even brick your phone.

The problem with this update was that rooted users would not be able to flash their Droid 2’s back to normal if they were bricked because the SBF files for that update version were not available yet.

Well, that problem has been solved! The folks over at MyDroidWorld have SBF files (version 2.3.20) that will take your device back to stock settings if indeed it becomes bricked.

Tutorial: Use audio files as ringtones, alarms or notification sounds (Windows)


So, you’ve got an awesome song you want as a ringtone, or a cool little sound effect to use as an SMS notification. The only question is, how do you get all that audio goodness onto your device? We’ll take a quick look at how to do that here.

The process is relatively simple. The first step is to get your phone hooked up to your computer, and to mount the SD card. When you plug in your phone via USB, pull down the top notification menu, and choose the option to mount the SD card. After a few seconds, you should get a message that your SD card is mounted and ready for file transfers.

At this point, open up “My Computer” on your PC, and choose the last removable disk. This should be your SD card in your phone. If you can’t figure out which device is your phone, unmount your SD card via the pull down menu on your phone, unplug your device, and see which removable device disappears inside your “My Computer” folder. When you plug the phone in again, the one that then appears is the phone.

Microsoft files patent lawsuit against Motorola’s use of Android code


Looks like Microsoft is trying to clear the path for their upcoming Windows 7 Phone as they are going after Motorola’s DROID series of phones which, of course, run Google’s Android mobile operating system.  Some of the details in the lawsuit regard Motorola’s code implementation of synchronizing email, contacts, and calendars, including the way meetings are scheduled.  It also covers the way battery level and signal strength notify applications.

In Microsoft’s defense, Motorola did license some of their mobile technology from 2003 to 2007 and supposedly failed to renew the license, yet continued to use it.  Still, it is unfortunate that the big boys can’t share the space in the handset market.  Microsoft has already called out Android as not really being “free”, stating that there is a lot of toe-stepping on patent infringement with the open source operating system.

Such accusations hold merit as there is already a case of Apple vs. HTC regarding the “slide to unlock” feature.  It looks like future Android manufacturers will need to tread more carefully as the smartphone market gets more crowded.

Microsoft Files ITC Suit Against Motorola for Patent Infringement in their Android Devices

Ah just what today needed, news of yet another lawsuit flung in the direction Android and its manufacturing partners. This time it’s Microsoft, not at all new to the patent-mincing game, looking in Motorola’s direction for alleged infringement of nine patents in their Android devices. Microsoft is calling to task processes for “synchronizing email, calendars and contacts, scheduling meetings, and notifying applications of changes in signal strength and battery power,” claiming Moto’s handling of such procedures is in violation of MS’s intellectual property.

While there is a pretty good chance this one will reach an out-of-court settlement, it could also fall into the other column of long, drawn out legal battles. Oh well, guess that’s the route you need to take when you spend your time releasing things like the Microsoft Kin.

Microsoft Files Patent Infringement Action Against Motorola

REDMOND, Wash. – Oct. 1, 2010 – Microsoft Corp. today filed a patent infringement action against Motorola, Inc. and issued the following statement from Horacio Gutierrez, corporate vice president and deputy general counsel of Intellectual Property and Licensing:

“Microsoft filed an action today in the International Trade Commission and in the U.S. District Court for the Western District of Washington against Motorola, Inc. for infringement of nine Microsoft patents by Motorola’s Android-based smartphones. The patents at issue relate to a range of functionality embodied in Motorola’s Android smartphone devices that are essential to the smartphone user experience, including synchronizing email, calendars and contacts, scheduling meetings, and notifying applications of changes in signal strength and battery power.

We have a responsibility to our customers, partners, and shareholders to safeguard the billions of dollars we invest each year in bringing innovative software products and services to market. Motorola needs to stop its infringement of our patented inventions in its Android smartphones.”

RIM files SurfBook trademark – possible name for BlackBerry tablet?

RIM has never been one to wait on things when filing for trademarks and patents. While waiting on any solid news up the upcoming BlackBerry tablet we’ve seen a few different names tossed around, of which "BlackPad "seemed to stick the most yet prove the most ridiculous. Well apparently RIM had filed for a trademark of the name "SurfBook"  in early August leading us to believe they may have made a semi-decent table name choice after all. There are no documented patents under the same name as of yet, but it looks like things are moving along in tablet land. So what do you think of the name "SurfBook"? Drop a comment with your thoughts.

Chatting with Kevin on this his thoughts are that it totally breaks their standard naming convention. Typically they stick with straight up, one word, one syllable names (Curve, Torch, Bold) so "SurfBook" seems a bit off — but just calling it "BlackBerry Surf" wouldn’t be bad at all and would fit much better with the current brands. Also, they would never cut their gabillion dollar brand name in half and use something like "BlackPad" (and BlackBerry BlackPad) is just wrong. Regardless of the name they go with, don’t get your hopes up that you’ll be seeing a BlackBerry tablet under the Christmas tree – early 2011 (late January if things go well) is where were thinking the release date is at now. Though that doesn’t mean they won’t announce it sooner. Fingers crossed we learn more about the tablet at DevCon next week.

Nokia closing down Ovi Files service on 1 October


As much as I love Nokia devices and services, I also get extremely frustrated with them from time-to-time. A couple of years ago it seemed like they were buying up as many services as they could with the hope that a global Ovi services offering would provide you with all you need. We have seen several of these services come and go (N-Gage, Mosh, Nokia Backup, etc.) to the point where I am now very leery of jumping onto any service they launch. I hope Ovi Maps never goes away, but you never know. Today we here that Ovi Files is shutting down on 1 October 2010.

I used the free 10GB Ovi Files cloud solution a few times, but never embraced it since I needed something that was more cross platform. Thankfully, we now have SugarSync on S60 so that I can share across multiple platforms and there really is little need for Ovi Files. I know that some people loved Ovi Files though and am sure they are not happy about this news today. It was a decision that was probably made after evaluating the cost and the benefit, but Nokia needs to now do things to prop up their name and not frustrate smartphone buyers.

Quick Tip: Finally download large files with BlackBerry 6!

One of the biggest complaints I have seen about the BlackBerry OS has been the very low (2.9mb) limit on file downloads from the internet. Well finally, RIM has addressed this massive complaint and now allows for large file downloads via the BlackBerry browser. As you can see in the screenshots above, I had no trouble downloading the latest CrackBerry Podcast straight from the internet (Bla1ze, you can smile now). While there is no word on what the actual max download is (if any), I have personally downloaded files in excess of 100mb which is all we really need. So if you have a new Torch 9800, get on that webkit browser and download away!

Internet-based phone service Skype filed with U.S. regulators on Monday to raise up to $100 million in an initial public offering, reports Reuters.

According to Skype’s S-1 filing for the SEC, it’s looking to grow the small and medium-sized businesses market for video chat and collaboration tools, as well as consumer video chat with premium features, such as group video chat. It did not specify the number of shares Skype would sell or give an expected price range, but it did say the company expects to trade on the Nasdaq.

In the first half of 2010, the company’s 560 million registered users logged 95 billion minutes of Skype voice and video calls, according to a regulatory filing. Net revenue rose 25.1 percent to $406.2 million in the first half of 2010 compared with a year earlier. In 2006, EBay sold off its controlling interest in Skype.

The network is operated by a company called Skype Limited, headquartered in Luxembourg and partly owned by eBay.

HTC files complaint to ban U.S. import of iPhone, iPad, iPod


HTC returned fire on Wednesday in the war over smartphone patents. The Android and Windows Mobile phone maker has filed a complaint with the ITC accusing Apple of patent infringement and asked for an import ban on iPhones, iPads, and iPods into the U.S.
